O Percurso Histórico Jurídico-Normativo Brasileiro da Proteção de Crianças e Adolescentes

RESUMO

Este artigo busca contemplar um resgate histórico jurídico-normativo acerca da política de atendimento destinada às crianças e adolescentes no cenário brasileiro. Para tanto, serviu-se do expediente de pesquisa bibliográfica sobre estudos que referenciem os diferentes períodos históricos e o aparato jurídico – normativo que direcionou a política de atendimento às crianças e adolescentes no Brasil. A pesquisa engloba tanto o período no qual crianças e adolescentes não estavam incluídas no aparato jurídico- normativo do Estado Brasileiro e sua inclusão nas Constituições, Código de Menores (1927 e 1979) e Estatuto da Criança e do Adolescente.  Sendo assim, aborda os diferentes momentos históricos que apresentam concepções fundamentais sobre a compreensão do atendimento destinado a crianças e adolescentes, e do que hoje se convenciona chamar de direitos e de doutrina de proteção integral.

ABSTRACT

The following paper tries to display the judicial and normative history regarding the assistance policy destined to children and adolescents in Brazil. Then, the author used a bibliographic research of studies that refer to the different historic periods and the normative legal system that have guided the assistance policy to children and adolescents in Brazil. The study comprises both the period in which children and adolescents were not included in the normative legal system of the Brazilian State, as well as when they were included in the Constitutions, The Código de Menores (Legislation for underage) (1927 and 1979) and the Estatuto da Criança e do Adolescente (Child and Adolescent Statute). Therefore, this paper deals with the different historic moments that present relevant concepts to understand the assistance for children and adolescents, and what is now called rights and full protection doctrine.
